2. General Information on Data Processing

I process personal data of users of this website only to the extent necessary to provide a functioning website and my content and services. Depending on the operation, the legal basis is your consent (Art. 6 (1)(a) GDPR), the performance or initiation of a contract (Art. 6 (1)(b) GDPR), a legal obligation (Art. 6 (1)(c) GDPR) or my legitimate interest (Art. 6 (1)(f) GDPR). This website is aimed at businesses; personal data usually arises as contact details of the people acting for them.

3. Hosting, Content Delivery and Access Data

The domain name patrickcoyle.de is registered with All-Inkl.com – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany; domain and DNS settings are managed via All-Inkl. The content of this website is built with and delivered from the landing page platform LanderLab (provider: Outofthebox Media Limited, Room 2106, 21/F., Lemmi Centre, 50 Hoi Yuen Road, Kwun Tong, Kowloon, Hong Kong). Delivery takes place via the content delivery network of Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA. When the page is accessed, technical access data (including IP address, browser type, date and time of access, page requested) is processed automatically in order to provide and deliver the website and to protect it against attacks. LanderLab additionally counts page views in aggregated form; Cloudflare collects technical performance data of the page via a performance beacon (Cloudflare Web Analytics). To my knowledge neither method sets cookies or builds user profiles. The legal basis is my legitimate interest in a functional, accessible and secure website (Art. 6 (1)(f) GDPR). Insofar as data is transferred to third countries, this is based on the EU-U.S. Data Privacy Framework in the case of Cloudflare and, in the case of LanderLab (Hong Kong), on the EU Commission's Standard Contractual Clauses (Art. 46 (2)(c) GDPR), which form part of my data processing agreement with the provider.

4. Cookies and Consent Management

This website uses the consent management tool Cookie-Script (provider: Cookie-Script.com). It records your choice in the cookie banner in a technically necessary cookie and ensures that services requiring consent are only loaded after you have agreed. As of the date of this policy, only technically necessary cookies are set on this website; no marketing or reach-measurement pixels within the meaning of section 6 are active. You can change your choice at any time via the "Cookie settings" link in the banner. The legal basis for technically necessary cookies is Sec. 25 (2) TDDDG in conjunction with my legitimate interest (Art. 6 (1)(f) GDPR); for all other cookies and technologies it is your consent (Sec. 25 (1) TDDDG, Art. 6 (1)(a) GDPR). Your language selection (DE/EN) is stored locally in your browser only and is not transmitted.

5. Fonts

The fonts and icon fonts used on this website are served locally from this website's own servers. No connection to Google or other font providers is established when the page is loaded.

6. Marketing and Reach Measurement (Meta, Google and Reddit Pixels)

To measure the effectiveness of my own advertising campaigns and to potentially re-target visitors of this website with advertising at a later stage (remarketing), I may use the following pixels. As of the date of this policy, none of these pixels is active. This policy will be updated before any activation; in any case the pixels are only loaded after you have consented to the respective category in the cookie banner.

Meta Pixel

Provider: Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland. The Meta pixel collects, among other things, your IP address, information about your browser and device, and your behaviour on this website (e.g. pages visited, clicks), and can match this data to your account if you are logged in to Facebook or Instagram. The purpose is to measure the success of advertisements and to build audiences. Further information: facebook.com/privacy/policy; opt-out: facebook.com/ads/preferences.

Google Ads Conversion Tracking and Remarketing

Provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. This processes, among other things, your IP address, pages visited and triggered conversion events in order to measure the success of Google advertisements and potentially display advertising to you again. Further information: policies.google.com/privacy; opt-out: adssettings.google.com.

Reddit Pixel

Provider: Reddit, Inc., 548 Market St, PMB 22712, San Francisco, CA 94104, USA. The Reddit pixel collects, among other things, your IP address, device information and your interaction behaviour on this website in order to measure the effectiveness of advertisements on Reddit and to build audiences. Further information: reddit.com/policies/privacy-policy.

The legal basis for the use of these pixels is your consent (Art. 6 (1)(a) GDPR, Sec. 25 (1) TDDDG), which you can withdraw at any time with effect for the future via the cookie settings. Insofar as data is transferred to the USA in this context, this is based, according to the respective providers, on the EU-U.S. Data Privacy Framework or on EU Standard Contractual Clauses.

7. Contacting Me

This website does not contain a contact form. If you contact me by email, via the WhatsApp link or via LinkedIn, I process the details you provide (e.g. name, company, email address, phone number, content of your message) in order to handle your inquiry and any follow-up questions. The legal basis is the performance of pre-contractual measures at your request (Art. 6 (1)(b) GDPR) or my legitimate interest in answering inquiries (Art. 6 (1)(f) GDPR). Inquiries that do not lead to a contract are generally deleted six months after the last communication, unless retention obligations apply.

8. Communication via Email, Google Meet, Slack and WhatsApp Business

Depending on your preference and the stage of our collaboration, I use the following channels to communicate with you:

Email, File Storage and Video Calls (Google Workspace)

My business email correspondence, the storage of related documents and video calls (initial call, kickoff) run via Google Workspace, in particular Gmail, Google Drive and Google Meet (provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland; processing may also be carried out by Google LLC, USA). Your messages, documents and the data processed in a video call (name, video and audio signal, connection data) are processed on Google's servers. Video calls are not recorded unless we expressly agree otherwise. The legal basis is the performance or initiation of a contract (Art. 6 (1)(b) GDPR) or my legitimate interest in efficient and secure communication (Art. 6 (1)(f) GDPR).

Slack

With individual clients, I additionally communicate via Slack at their request (provider: Slack Technologies Limited, Salesforce Tower, 60 R801, North Dock, Dublin, Ireland; data may also be processed by Salesforce, Inc., USA). This involves processing the messages and files you share there. The legal basis is the performance or initiation of a contract (Art. 6 (1)(b) GDPR).

WhatsApp Business

This website includes a link to my WhatsApp Business account, through which you can contact me directly. If you use this link, your phone number and the content of your messages will be processed by WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (a Meta Platforms, Inc. group company, USA); WhatsApp may also collect metadata (e.g. time and duration of communication, device used). The use of WhatsApp is voluntary; if you do not wish to use it, you can reach me by email instead. The legal basis is your consent, which you grant implicitly by contacting me via the WhatsApp link (Art. 6 (1)(a) GDPR), or, insofar as this results in the initiation of a contract, the performance of pre-contractual measures (Art. 6 (1)(b) GDPR). For all of these channels, data may be transferred to the USA. According to the respective providers, this is based on the EU-U.S. Data Privacy Framework, under which Google, Meta and Salesforce are certified, or on EU Standard Contractual Clauses.

9. Contract Initiation, Conclusion and Invoicing

If your inquiry leads to a concrete offer, I collect the information required for the contract (including company name, legal form, VAT ID, billing address, contact persons, email addresses) via a form provided by Tally (tally.so, based in Belgium, processing within the EU). For the electronic signing of offers and contracts, I then use the service Yousign (provider: Yousign SAS, 8 rue Bernard Palissy, 44000 Nantes, France); processing takes place within the EU. After the contract is concluded, I use the software sevdesk (provider: sevdesk GmbH, Panoramastraße 1, 70174 Stuttgart, Germany) for invoicing, which processes the names, addresses and contact details of my contractual partners as well as the services billed. The legal basis is the performance or initiation of a contract (Art. 6 (1)(b) GDPR) and, to the extent that contract and invoicing data must be retained for legal reasons, the fulfilment of a legal obligation (Art. 6 (1)(c) GDPR, in particular Sec. 147 of the German Fiscal Code (AO) and Sec. 257 of the German Commercial Code (HGB)). Contract and invoicing data is retained for the statutory periods (generally ten years). Data processing agreements are in place with the providers named.

10. Your Rights

You have the following rights with respect to me regarding personal data concerning you: the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing based on legitimate interests (Art. 21), and the right to withdraw any consent given at any time with effect for the future (Art. 7 (3) GDPR).

You also have the right to lodge a complaint with a data protection supervisory authority about my processing of your personal data, for example with the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht), Promenade 18, 91522 Ansbach, Germany.
